By creating an account, accessing, or using RUSH FITNESS ("the Service"), you agree to be bound by these Terms of Service. If you are under 18, your parent, guardian, or school must accept these Terms on your behalf. If you do not agree, do not use the Service.

For institutional users (schools, athletic departments, coaches acting on behalf of an institution), the individual creating or managing the account represents and warrants that they have authority to bind the institution to these Terms.

RUSH FITNESS is an AI-powered sports biomechanics analysis platform that provides form correction feedback for weightlifting and athletic movements. The Service uses pose estimation technology and AI models to analyze video recordings of athletic technique and generate coaching feedback.

The Service is designed for athletes aged 13 and older. The Service is not a medical device and does not provide medical advice, diagnosis, or treatment.

You must be at least 13 years old to use the Service. Users under 18 must have parental or guardian consent, or participate through a school-sponsored program with institutional authorization.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information during registration and onboarding.

You agree not to:

• Upload videos of other individuals without their consent, or videos you do not have the right to share
• Use the Service for any unlawful, harmful, or abusive purpose
• Attempt to reverse engineer, decompile, or extract the AI models, pose estimation algorithms, or proprietary systems
• Share account credentials or allow unauthorized access to Pro/Team features
• Upload content containing explicit, violent, or otherwise inappropriate material
• Use the Service in a manner that could damage, disable, or overload the platform infrastructure

The Service offers Free, Pro ($9.99/month), and Team subscription plans. Subscription fees are billed through Base44 Payments at the time of purchase and recur monthly until canceled. You may cancel at any time; cancellation takes effect at the end of the current billing period.

Institutional (Team) plans are managed by the school's athletic director or authorized administrator. Seat allocations and billing are governed by the institutional agreement.

Refunds, if applicable, are handled on a case-by-case basis. Contact your institution or the app support team for assistance.

The form analysis, coaching feedback, injury risk assessments, and recommended drills generated by the Service are produced by AI models and are for educational and training purposes only. They are not a substitute for professional coaching, athletic training, or medical advice.

AI-generated feedback may contain inaccuracies. You are responsible for using your own judgment and consulting qualified professionals before acting on any recommendations.

You retain ownership of videos and content you upload. By uploading, you grant RUSH FITNESS a license to process, analyze, and temporarily store your content solely for the purpose of providing the Service, as described in our Privacy Policy and Data Retention Policy.

You represent that you have the necessary rights and consents to upload any video, including consent from any individuals depicted, particularly minors.

The Service, including its design, features, AI models, coaching content, and software, is owned by RUSH FITNESS and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without authorization.

We may suspend or terminate your account if you violate these Terms or engage in conduct harmful to the Service or other users. You may delete your account at any time through the app settings or by request through your institution.

Institutional accounts may be terminated by the school's athletic director or by RUSH FITNESS for non-payment or policy violations.

The Service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, RUSH FITNESS shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to injuries, lost performance, or data loss arising from use of the Service.

You acknowledge that athletic activity carries inherent risk, and the Service does not eliminate that risk. See our Liability Waiver for details.

These Terms shall be governed by the laws of the jurisdiction in which RUSH FITNESS operates, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration where permitted by law.

We may update these Terms from time to time. Material changes will be communicated through the app or to institutional administrators. Continued use after changes constitutes acceptance.
